Terms of Service

These terms are an agreement between you and My Locket (“My Locket”, “we”, “us”). By creating an account, building a timeline, talking to a persona, or otherwise using My Locket, you agree to them. If you do not agree, do not use My Locket.

Please read the sections on AI personas, your content, misuse, and limits on our liability carefully. They affect your legal rights.

Who can use My Locket

You must be at least 18 years old, and old enough to form a binding contract where you live. You must give us accurate information, including your date of birth, and keep your sign-in details secure. You are responsible for everything that happens under your account.

AI personas

A persona is an AI re-enactment generated from the details on a timeline. It is not the person it represents, and it does not speak for them. Every reply from a persona is generated by AI, even though a persona stays in character and will not say so. See our Statement on AI Usage.

By using My Locket, you understand and agree that:

AI output can be wrong, incomplete, inconsistent, out of character, or upsetting, however carefully a timeline has been built. A persona may misremember, invent, or misstate things.
Nothing a persona says is a statement of fact, a statement by the real person, or a statement by My Locket.
Nothing a persona says is medical, psychological, legal, financial, or any other professional advice, and you must not rely on it as such. A persona is not a therapist or a crisis service. If you are in crisis, contact local emergency services or one of the services listed in our Statement on AI Usage.
Talking to a persona of someone who has died, or someone you have lost, can bring up strong emotions. You use My Locket at your own emotional risk and are responsible for deciding whether it is right for you.
You are solely responsible for what you do, decide, believe, or say to others based on a conversation with a persona.
We may change, limit, or filter how personas behave at any time, including the AI models and providers behind them.

Your content

“Your content” means everything you put into My Locket: timelines, profiles, places, property, relationships, health details, events, pictures, and messages to personas.

You own your content. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, and display it, and to send it to our service providers (including our AI provider), only as needed to run My Locket for you and the people you share with. This licence ends when your content is deleted, except for personas you choose to preserve for others and copies we must keep by law.

You are solely responsible for your content. We do not review timelines before they are used, and we do not check that anything on them is true. By adding content, you promise that:

You have the right to add it, including any pictures, and it does not infringe anyone’s rights.
Where it is about another person, especially a living one, you have the right to share it, it is not defamatory, and it does not invade their privacy or break any law that protects them.
You have a legitimate reason to represent anyone you add, and you will treat them with care and respect.
Health details are optional. Where you add any about another person, you have their agreement, or another lawful basis, to record and share them, and you will remove them if that person asks you to.
It does not break these terms or any law.

If someone believes content on My Locket is about them and is unlawful or harmful, they can contact us and we will review it. We may remove any content, or disable any persona, at any time and for any reason, without notice.

What you must not do

You must not use My Locket, or any persona, to:

Create sexual content, or any content that sexualises a minor in any way.
Impersonate, deceive, or defraud anyone, including by presenting a persona’s words as the real person’s.
Harass, threaten, bully, stalk, defame, or intimidate anyone, living or dead.
Create a persona of a person to harm them, their reputation, or the people close to them.
Obtain instructions for, plan, promote, or carry out anything illegal, violent, or dangerous.
Promote self-harm, suicide, or eating disorders.
Upload content you do not have the right to use, or someone else’s private information without a right to.
Generate content for political campaigns, spam, or deceptive purposes.
Break any law that applies to you or to us.

Attacks, jailbreaks, and abuse of the service

My Locket and its personas have safety limits built in. Attempting to get around them is strictly prohibited. You must not, and must not try to, or help anyone else to:

“Jailbreak” a persona or our AI: use prompts, role-play, encoded text, hidden instructions in a timeline, or any other technique to make it ignore its instructions or safety limits, reveal its instructions, or produce content these terms forbid.
Inject instructions into timelines, pictures, or messages to manipulate the AI or other users’ personas.
Access any account, persona, timeline, or data you are not authorised to, or get around sharing, credits, payment, rate limits, age checks, or any other access control.
Probe, scan, or test the vulnerability of My Locket, or breach or bypass any security or authentication measure.
Interfere with or disrupt the service, including by overloading it, sending malware, or using bots, scrapers, or automated tools without our written permission.
Reverse engineer, decompile, copy, or resell any part of My Locket, or use it to build a competing product.
Commit payment fraud, chargeback abuse, or misuse of credits.

We take this seriously. If we believe you have attempted any of the above, we will permanently ban you and any related accounts, without notice or refund. We will also pursue every legal remedy available to us to the fullest extent the law allows. This includes reporting you to law enforcement, cooperating fully with any criminal investigation and prosecution, including under computer misuse and fraud laws, and bringing civil claims against you for damages, costs, and legal fees. We keep logs and records needed to detect, investigate, and act on this kind of activity, and may share them with law enforcement.

Sharing

When you share a persona, or create a chat link, the people you share with can see and talk to it as your sharing settings allow. You are responsible for who you share with and what they can see. We are not responsible for what other people do with anything you share with them, including copying it or showing it to others.

Credits, unlimited months, and Forever

Prices are shown before you buy, and payments are processed by Stripe. Credits and unlimited months have no cash value, cannot be transferred except by giving them to personas within My Locket, and cannot be exchanged for money. Once credits or months have been given to a persona, they cannot be moved back.

Forever means unlimited conversation with one persona for as long as My Locket operates the service. It is not a promise that My Locket, any AI model, or any particular feature will exist forever. If we stop offering My Locket, we will give reasonable notice where we can and, where possible, a way to export your timelines.

Except where the law requires otherwise, all purchases are final and non-refundable, including if your account is suspended or ended for breaking these terms. If you believe you were charged in error, contact us before disputing the charge with your bank.

Our service

We may change, suspend, or stop any part of My Locket at any time. We do not promise that it will always be available, error-free, or secure, or that your content will never be lost. Keep your own copy of anything that matters to you.

My Locket’s name, logo, design, software, and everything else we provide (other than your content) belong to us or our licensors. These terms give you a personal, revocable right to use My Locket as intended, and nothing more.

Suspension and termination

You can delete your account at any time from your account page. We may suspend or end your account, remove content, or disable personas at any time, with or without notice, if we believe you have broken these terms, put others at risk, or exposed us to legal liability. The sections on your content, misuse, disclaimers, limits on liability, indemnity, and disputes continue to apply after your account ends.

Disclaimers

My Locket, including every persona and everything a persona says, is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability, non-infringement, and that the service will be uninterrupted or free of harmful content. We do not endorse, and are not responsible for, any content created by users or generated by AI.

Limits on our liability

To the fullest extent the law allows:

We are not liable for anything a persona says or generates, for any content you or other users add, or for anything anyone does or decides because of it.
We are not liable for emotional distress, or for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or reputation, however caused and even if we were told they were possible.
Our total liability to you for all claims relating to My Locket is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US$100.

Some places do not allow some of these limits. Where that is the case, they apply only as far as the law allows.

Indemnity

You agree to defend, indemnify, and hold harmless My Locket and its owners, employees, and contractors from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising from your content, your use of My Locket or any persona, what you do with anything a persona says, your sharing, or your breach of these terms or of anyone’s rights.

Disputes

These terms are governed by the laws of [governing jurisdiction], without regard to conflict of law rules. Any dispute will be resolved exclusively in the courts of [venue], and you consent to their jurisdiction. Nothing here stops us from seeking urgent relief, such as an injunction, in any court, or from reporting unlawful activity to any authority.

General

These terms, together with our Privacy Policy and Statement on AI Usage, are the whole agreement between you and us. If any part is found unenforceable, the rest still applies. If we do not enforce a term, we have not waived it. You may not transfer these terms; we may, including as part of a sale or reorganisation.

We may update these terms. If a change matters, we will tell you before it takes effect. If you keep using My Locket after that, you accept the updated terms.
